नई दिल्ली: देश के सर्वोच्च न्यायालय ने जिला अदालतों में जजों की कमी पर चिंता व्यक्त की है। कहा कि अदालतों में जजों की कमी के कारण पोक्सो (Protection of Children from Sexual Offences Act) मामले की सुनवाई में देरी हो रही है। सुप्रीम कोर्ट ने चार मार्च को कहा कि विशेष पोक्सो अदालतों का गठन तो किया गया है, लेकिन जजों की कमी के कारण काफी मामले पेंडिंग हो गए हैं। पहले दिए गए कई निर्देश भी जजों की कम संख्या के चलते व्यावहारिक रूप से लागू नहीं हो पा रहे हैं। आपको बता दें कि बच्चों के खिलाफ हुए अपराध के मामले में पोक्सो के तहत केस दर्ज किया जाता है।
जस्टिस बेला एम. त्रिवेदी और जस्टिस पी. बी. वराले की पीठ ने संज्ञान लेते हुए पोक्सो एक्ट के तहत न्याय प्रक्रिया में प्रैक्टिकल खामियों पर विचार किया। कोर्ट सलाहकार सीनियर वकील वी. वी. गिरी ने अदालत को सूचित किया कि पोक्सो अदालतों की स्थापना, विशेष अभियोजन पक्ष वकील की नियुक्ति और इससे जुड़े कर्मियों के प्रशिक्षण संबंधी दिशा-निर्देश पहले ही पारित किए जा चुके हैं, लेकिन उनके अनुपालन पर नजर रखना जरूरी है।
जस्टिस बेला त्रिवेदी ने कहा कि पोक्सो अदालतें और विशेष अभियोजक मौजूद हैं और इससे जुड़े व्यक्तियों का प्रशिक्षण भी जारी है। हालांकि, जजों की भारी कमी के कारण मामलों का निपटारा नहीं हो पा रहा है। हमारे पास जज नहीं हैं। हम जज कहां से लाएं? सभी अदालतें पहले से ही बोझिल हैं। जजों के पद खाली पड़े हैं और कोई उनकी तैयारी नहीं कर रहा है। सुप्रीम कोर्ट ने मामले को 25 मार्च तक अगली सुनवाई के लिए स्थगित कर दिया है। (एजेंसियां)
Protection of Children from Sexual Offences
New Delhi: The Supreme Court of India has expressed concern over the shortage of judges in district courts, which is causing delays in the hearing of cases related to the Protection of Children from Sexual Offences (POCSO) Act.
The court stated that while special POCSO courts have been established, the shortage of judges has resulted in a significant backlog of cases. The Supreme Court bench, comprising Justice Bella M. Trivedi and Justice P.B. Varale, took note of the practical difficulties in the justice delivery process under the POCSO Act.
The court was informed that guidelines had been issued earlier regarding the establishment of POCSO courts, appointment of special public prosecutors, and training of personnel involved. However, the court emphasized the need for effective implementation of these guidelines.
Justice Trivedi observed that while POCSO courts and special public prosecutors are in place, the acute shortage of judges is hindering the disposal of cases. “We don’t have judges, where will we get them from? All courts are already overburdened, and judicial posts are lying vacant,” she said. The Supreme Court has adjourned the matter for further hearing on March 25.
