హైదరాబాద్ : డా. బి. ఆర్. అంబేద్కర్ ఓపెన్ యూనివర్సిటీలో రాజ్యాంగ దినోత్సవాన్ని పురస్కరించుకొని “రాజ్యాంగం, నేరం మరియు ప్రజాస్వామ్య నైతికత” అనే అంశంపై ఉపన్యాసాన్ని నిర్వహించారు. ఈ కార్యక్రమానికి ముఖ్య అతిథిగా కేంద్ర సమాచార కమిషన్, మాజీ కమిషనర్, మహీంద్రా విశ్వవిద్యాలయం, (హైదరాబాద్) ఆచార్యులు మాడభూషి శ్రీధర్ హాజరై ప్రసంగించారు.
ఆచార్యులు మాడభూషి మాట్లాడుతూ రాజ్యాంగంలోని ప్రధాన సూత్రాలు, ప్రక్రియలను ప్రస్తుత పరిస్థితులు చూస్తుంటే అణగదొక్కే చర్యగా కనిపిస్తోందని అభిప్రాపడ్డారు. డా. బి. ఆర్. అంబేద్కర్ స్ఫూర్తికి ఇది విరుద్ధమని ఆయన వివరించారు. ఇది సహజమైన భావన కాదని, ప్రజాస్వామ్య విలువలకు విరుద్ధమని, రాజ్యాంగ విలువలను కాపాడాలని సమాజంలో ప్రజాస్వామ్యం వృద్ధి చెందాలంటే దానిని పెంపొందించుకోవాల్సిన అవసరం ఉందని ప్రొ. శ్రీధర్ అభిప్రాయపడ్డారు.
రాజ్యాంగాన్ని రక్షించడం అంటే ప్రజాస్వామ్యంలో రాజకీయ నేతల, సంస్థల నైతిక విలువలు, పారదర్శకత, జవాబుదారీతనం, ప్రజాస్వామ్య ప్రక్రియలను గౌరవించడం మొదలగునవి ముడిపడి ఉంటాయన్నారు. రాజ్యాంగ నైతికత అంటే న్యాయం, స్వేచ్ఛ, సమానత్వం, సోదరభావం, లౌకికవాదం, చట్టపరంగా చేసే పాలన వంటి రాజ్యాంగంలో పొందుపరచబడిన ప్రధాన విలువలు, సూత్రాలకు కట్టుబడి ఉంటుందన్నారు. రాజ్యాంగం ఆత్మగా పరిగణించబడుతు, ప్రభుత్వ, న్యాయవ్యవస్థ, పౌరుల చర్యలను మార్గనిర్దేశం చేస్తుందన్నారు. తద్వారా దోషిగా నిరూపించబడే వరకు నిర్దోషిగా భావించే రాజ్యాంగ సూత్రాన్ని ఉల్లంఘిస్తుందని అన్నారు.
రాజ్యాంగ నైతికత చట్టబద్ధంగా అమలు చేయగలిగినప్పటికీ, రాజకీయ లేదా ప్రజాస్వామ్య నైతికతను అనేక అంశాలను చట్టంలో ఖచ్చితంగా క్రోడీకరించబడలేదుని వివరించారు. తీవ్రమైన నేరానికి శిక్ష పడితే పదవి నుండి అనర్హతకు దారితీయవచ్చు, నేరారోపణలు చాలా కాలం పెండింగ్లో ఉండటం ప్రజాస్వామ్య స్ఫూర్తికి వ్యతిరేకం అని, తీవ్రమైన నేర ఆరోపణలు ఎదుర్కొంటూ రాజకీయ నేతలు ఇప్పటికీ పదవిలో కొనసాగుతున్నారని ఇది ప్రజాస్వామ్య స్ఫూర్తికి విరుద్ధమన్నారు. పెండింగ్లో ఉన్న క్రిమినల్ కేసులు పేరుకుపోవడం అనేది రాజ్యాంగ, న్యాయ వ్యవస్థ పట్ల చులకన భావాన్ని తెస్తుందన్నారు.
కార్యక్రమానికి విశ్వవిద్యాలయం వైస్-ఛాన్సలర్ ప్రొఫెసర్ ఘంటా చక్రపాణి అధ్యక్షత వహించి. మాట్లాడుతూ ప్రజాస్వామ్య నైతికత ఎలా విఫలం అవుతున్నది అనే విషయం స్థూలంగా ప్రస్తావించారు. ప్రజాస్వామ్య నైతికత విఫలం అయితే రాజ్యాంగం పూర్తి స్థాయి అమలులో విఫలం అవుతదని, రాజ్యాంగ చివరి సభలో సమావేశంలో డా. బి .ఆర్.అంబేద్కర్ గారు స్పష్టంగా ప్రస్తావించారని వివరించారు.

Hyderabad: Dr. B. R. Ambedkar Open University organized Constitution Day Lecture on “Constitutional Criminality and Democratic Morality” as part of Constitution Day Celebrations at its campus.The Chief Guest Prof. Madabhushi Sridhar Acharyulu, Former Central Information Commissioner & Professor, School of Law, Mahindra university, Hyderabad delivered the lecture on “Constitutional Criminality and Democratic Morality”.
Prof. Sridhar said He said that the current situation seems to be an act of undermining the main principles and processes of the Constitution. He explained that this is against the spirit of Dr. B. R. Ambedkar. This is not a natural concept, it is against the values of democracy, and it is necessary to protect the values of the Constitution and develop it if democracy is to flourish in the society.
The protecting the Constitution means the moral values of political leaders and institutions in a democracy, transparency, accountability, respect for democratic processes. Constitutional morality means adhering to the main values and principles enshrined in the Constitution such as justice, freedom, equality, fraternity, secularism, rule of law. The Constitution is considered as the soul and guides the actions of the government, judiciary and citizens. He said that this violates the constitutional principle of being innocent until proven guilty.
He explained that although constitutional morality can be legally enforced, many aspects of political or democratic morality are not precisely codified in law. Conviction for a serious crime can lead to disqualification from office, he said, adding that the prolonged pendency of criminal charges is against the spirit of democracy, and that political leaders facing serious criminal charges are still in office. He also said the accumulation of pending criminal cases brings a sense of disrespect to the constitution and the judicial system.
Prof. Ghanta Chakrapani, Vice-Chancellor, BRAOU presided over the program. He mentioned how democratic ethics are failing. He explained that if democratic ethics fail, the Constitution will fail in its full implementation, which Dr. B. R. Ambedkar had clearly mentioned in the last session of the Constitution.
Prof. G. Pushpa Chakrapani, Director Academic RAOU explain the significance of program and introduced about the Chief Guest. Dr. L. Vijaya Krishna Reddy, Registrar of proposed vote of thanks. Earlier, the chief guest Prof. Madabhushi Sridhar; Prof. Ghanta Chakrapani, Vice-Chancellor; Prof. G. Pushpa Chakrapani, Director Academic; Dr. L. Vijaya Krishna Reddy, Registrar all the Directors, Deans, Heads of the branches, Teaching and Non-teaching Staff members and representatives of various service associations offered floral tributes to Dr. B. R. Ambedkar Statue, recited the Preamble to the Constitution and pledged to protect the values of the Constitution.
